I found a document from the CRB that makes for some interesting reading:

http://www.loc.gov/crb/proceedings/2005-1/rates-terms2005-1.pdf

I haven't read the whole thing yet, but in scanning through it I find this
comment rather telling:

Small Commercial Webcasters' focus on the amount of the fee, rather than how
it should be structured,

is further underlined by the absence of evidence submitted by this group to
identify a basis for

applying a pure revenue-based structure to them. While, at times, they
suggest that their situation

as small commercial webcasters requires this type of structure, there is no
evidence in the record

about how the Copyright Royalty Judges would delineate between small
webcasters and large

webcasters.*

* Indeed, since none of the small commercial webcasters participating in
this proceeding provided helpful evidence about what demarcates a "small"
commercial webcaster from other webcasters/simulcasters at any given point
in time, any determination that a revenue-based metric was somehow uniquely
applicable to small commercial webcasters would be speculative.

Another scary thing about the CRB judges is that, from what I see, they are
appointed for life. Yippee.

Yep...hobbyists and small business owners are the dominant species in
Internet radio. Asking Jim Johnson to move from his hometown of Des
Moines, Iowa just to pursue one of many possibilities for his dot-com
business is unreasonable.

This will effectively kill small- and medium-sized webcasters if it's
not repealed. Mark my words.
