That's entirely possible, although usually one would expect the results 
to be the other way 'round - a Class 8, which nominally would provide 
"up to 8x" would be legal if it only gave 4x.
    Kind of like a motorcycle called a GoFast-800 when it only has a 
749cc engine.
    I guess the only real test is whether a certain card works as 
desired in a certain device.
