Yep, it's a little scary. This is why folks are waiting anxiously to see it enforced in court. The case precedent will mean a LOT to the GPL and open source community. That said, even if it's proved unenforceable, it's not like the sky will fall. We would just end up in a much more BSD-ish world for a while until some lawyers draft an enforceable version.
