It's most definitely non-free! It's also not ideal because I know for a fact it does "phone home" to Silicon Dust for support (this is clearly documented). I haven't investigated more at this point but it would be a good idea to ask SD if they'd consider publishing their firmware for the smaller tuners (or all) under a free license.
