No, it's not. You could try using Linux-libre sources and patching those.  
Looks like Debian has some related patch packages but ubuntu has removed  
those, wonder why.

The license is good and I couldn't see anything funny in the patch. It's also  
listed at the FSF free software directory [0] so I think it's free.
