I think you don't understand the problem. The white list is the problem. Your  
HP might have had an Atheros chip in its white list, but most don't. You got  
lucky it sounds like. The reality is this practice almost always causes a  
problem for people moving to free software. You can point to systems that  
aren't implementing the restrictions probably. I believe Dell's Alienware  
line-up might not have the restrictions for instance- or it appeared that way  
to some user on these forums at some point.
