The FSF doesn't have a stake of copyright in Linux, so contacting them about  
this would be pointless (they have nothing to do with it).

I'd wager to guess it isn't a license violation, though. The driver is  
probably distributed alongside some other software (like firmware) needed for  
the hardware to actually work. Hard to say without looking thoroughly into  
it, though.
