Yes, you're right, an overt becomes an overt only at the receipt point.

That's also the reason why it's so very hard sometimes to tell if one is
committing an overt or not.

And that's also why it's so very hard to apply Scientology's ethics system.
You just can't always say in advance if something is going to have
bad consequences or not (is going to be an overt or not). Even if you think
it should have good consequences on the receiver, he may have a different
idea and vice versa.

So one just does the best one can in judging one's actions towards others
(intelligence in estimating force). But as a guideline it's certainly not
wrong to stick to the idea of not overwhelming (or in other words: not
having to win a serious game by all means).
