The article is quite vague as to what is meant by "some action", but this should not be interpreted as somehow disciplining Letterman. What CBS probably needs to do is make a good faith effort to determine if there was any kind of sexual harassment going on in this situation. This would involve interviewing employees in a neutral and confidential environment. It certainly is possible that they might find some misconduct, and if they did they would have to take some additional action - but nothing we have heard so far suggests that misconduct actually took place. One thing that is unclear to me - is Dave in any sense an employee of CBS? Does WP own the show? The article says Dave probably has a morals clause in his contract with CBS - what kind of contract does Dave have with CBS? Perhaps they are talking about a contract between Worldwide Pants and CBS?
