As silly as these stories sometimes look, in serious cases a company
has to be able to show a court that they have been actively protecting
their trademark. The problem is that a cease-and-desist letter from
the big company's legal counsel often comes from out of the blue with
its threatening language. In this case it's also possible that the
Mayan Institute paid a lot of money to  graphic designer and wants to
protect its investment.
