Stern claimed that he was due $330M in stock from the merger of Sirius and 
XM and the added XM subscribers that could pick up his show, SXM 
disagreed--the court threw it out "with prejudice," meaning Stern can't 
refile the suit:

Stern's staying where he is, of course, since terrestrial radio isn't more 
friendly to this style of radio now than it was when he moved to Sirius in 
2004--some subscribers, including Judd Apatow on his Twitter feed, seem to 
be not be happy about his recent tendency to make most of his show about 
him joining "America's Got Talent" and endless plugging of the show--just 
like his last months on terrestrial radio were mostly devoted to the 
superiority of Sirius, much to the anger of many of the stations carrying 
him.
