I worked for several years as a forensic psychologist at a state hospital,
and had to write numerous reports and letters evaluating murderers and
rapists who had been found not guilty by reason of insanity for the
potential for future violence. The first thing to know is that mental
health professionals are not particularly good at making these kinds of
predictions. The second is that nobody who writes these kinds of reports
wants to be the guy who signed off on releasing someone who later killed or
raped again. Which is to say that when you do see a report recommending
release, you have to give it some weight. I have followed the Hinckley case
closely over the years, and used it often in class. If he had shot anyone
else he likely would have been released years ago. Then again, he did not
shoot anyone else, and I think it is reasonable to have a higher threshold
for someone who has tried to murder the president of the United States. I
doubt the Obamas, Clintons or Trumps are happy about this, in addition to
many others noted already. Still, given the law and common practice, his
release is probably justified. My main disagreement with the court is that,
given his proximity to the nation's capital, I think a mandatory tracker is
justified as well. The Secret Service has a legitimate interest in knowing
his location at all times.
