IANAL, but cake design probably falls more cleanly under trademark law.
Regardless, I think Goldman (still based in Baltimore, I think), would want to
preserve his brand identity from potential copycats, regardless of any legal
violation. Certainly elements like the Presidential seal would fall outside of
intellectual property rights, but again, IANAL.
Now, how many people are that up to speed on cake design to wonder if Goldman
did the Trump cake? I have no idea, but I'd be surprised if it was a large
number. But if he received questions about it, I can understand why he'd try
to clarify.
