The laws vary slightly from state to state, but they're generally the same over here. You'd need to get permission from all parties to identify them on the show. Which means either the producers paid off the cheater to get his permission. Or the entire thing was staged from the beginning.
But, surely nobody would do that, just to create a salacious TV show, right? If you were doing this in the UK, then you'd have to get permission from *both* parties, otherwise at the very least you'd need to do a lot of blurring. If someone is doing something illegal, then it's fine to feature them, but having an affair isn't illegal.
