Before the same judge that once ruled that Spencer Elden filed his original 
complaint over the *Nevermind* cover photo after a statute of limitations 
expired, only to have it tossed right back in his lap by an appeals 
panel... this round he rehashed parts of the first ruling about the lack of 
"lascivious" content, along with Elden's embracing of the role in recent 
years, not only of the title:
