The API is open, but the source backing the API is not (so the GPL is
irrelevant). As far as the lawsuit question, although I do not work/speak
for Twitter, I think it would be very poor form for them to be suing people
in their ecosystem except for the unbelievably most obnoxious and grossest
offenders and I very much doubt they have that in their business plan.
