If Freescale distributes the code (like you are doing by enabling
download from a publicly available server) then you *MUST* adhere to
the GPL license conditions which apply to that code. And GPL is one
of the approved Open Source licenses, see
http://www.opensource.org/licenses


I am pretty sure you are aware of this and meant something  different
(not submitted to the mainline tree, resp. o the public mailing list,
or  similar),  but  it  is  important to use precise terms, so please
allow for this small correction.
