It's illegal to send UBE (unsolicited bulk e-mail) here in the states, but
that doesn't stop people from finding loopholes in the FCC regs or spoofing
source addresses and IPs. If the post office didn't track where mail came
from/went, you could put any return address on an envelope and no one would
ever know it wasn't accurate. Heck, you might still be able to do that in
some cities. Spamming has become a science of high marketing and sneaky
technology all in itself. Your e-mail address only needs to be in one spot,
on one scannable e-mail/web page/Usenet post/forum posting, to become shared
with millions of marketing databases around the world. After using my e-mail
address to sign up for a (opt-out only, as I finally found out) software
tool, I began getting hundreds of spam e-mails a day. I won't name the
source or time it happened. I had to change my address. Everytime you
carelessly use your e-mail address, your exposure to the 'spam net' is
increased and reaffirmed. Sometimes, you don't have a choice but to give in
to get something you really want. Then, you should use a disposable address
or forwarding alias.

 If you can trace the spam to a specific source that does not have a
publicly posted opt-in/opt-out disclaimer and/or a publicly posted privacy
policy(say that 3 times real fast..LOL), you could easily win damages in a
U.S. court. Unfortunately, with the insecurity of e-mail and the inherent
lack of validation on spam e-mail servers' part, any smart spammer can make
it impossible to determine where the e-mail came from. Or worst, make it
look as though another company sent it. We get complaints about that daily
and there is *nothing* we can do about that, except try to make the victim
understand. That pisses me off the most. There are *way too many* 'loose'
e-mail servers on our backbones. All that's required to cut spam in at least
half, is for all relaying e-mail servers to perform a reverse DNS lookup on
the from e-mail address. It can be compared with the IP of the host sending
it, before the e-mail relayed. I'll take spam in my inbox all day long, over
having our company name slandered by some shmuck sending viruses and
spam(which is illegal - yet it can't be proven). How many people are really
going to spend $ and time to correctly identify and take a company or
organization to court over spam? It's a catch 22. We won't fight it legally,
yet we bitch about it constantly and point fingers at our service providers.
Even with their spending and effort, the war is still far from over. The
only real way to win, is to stop using e-mail.
