I don't believe that emerald themes are going to be default in 8.10... at least I haven't heard any such news. So it's a metacity theme (which is run by Compiz's gtk-window-decorator).
I couldn't install your theme however: ""Intuition_by_newversion2.gz" does not appear to be a valid theme."
