I can confirm that this bug is still present in hardy. I apt-get-install, say, ubuntu-restricted-extras, which pulls in flashplugin-nonfree. The pair of questions come up first at the "Preconfiguring packages" stage, and again at the "Setting up flashplugin-nonfree" stage.
This is on a clean system that has never seen those packages before.
