The "configuration file modified" is the warning about conflicting
settings; it warns you that:

   A new version of /boot/grub/menu.lst is available, but the version
installed currently has been locally modified.

I.e.: you've changed the 'root' setting by hand and have not updated the
'groot' template.  So when you choose "install maintainer's version",
you're telling update-grub to reset the entries to all point to (hd0,0)
again, since that's what the groot entry says.

You need to change your groot entry to point at the right device,
otherwise update-grub will continue o get it wrong.

As for this:

that /is/ the default; if you chose "install maintainer's version",
that's a non-default option.

So while I would like for us to be able to make this more robust, that's
really not possible with the current grub; and the system is working as
it was designed to do.  Marking this bug 'wontfix'.
