With 8.10 and 2.6.27-9, I still had this issue. I tried to move from 177 (which worked okay, but showed artifacts on titlebars in windows, a known bug, upstream) to 173 (which too seemed to have the titlebar issue, about which I found out later), it wouldn't work right.
I had to remove my kernel-headers (also removed and reinstalled build- essential and it's deps, dunno tho if that's an issue), it worked fine to build 177 after that. However, the best solution I see was to use the newest drivers and kernel (-10) from intrepid-proposed. It seems they are patched, and now everything works perfectly - I've successfully migrated from 177 to 173 and from 173 to 96 (which has not the nasty titlebar bug), using only the Proprietary driver properties gtk2 manager from System->Administration.
