This is what happens to me: sometimes the notification is not overlapping, some other it's overlapping. It depends on the login. Once it's overlapping, it is for the whole session (the same if it's not overlapping).
I have compiz, a normal desktop panel (top). I removed the bottom panel from /apps/panel/general/toplevel_id_list in favour of avant window navigator. I also have an user with a standard ubuntu session.
