I have the same problem now (8.10). Haven't noticed this before, but I rarely use the Trash in Nautilus.
I have tried to delete /home/myuser/.local/share/Trash and also roots trash (to make them regenerate to make sure there isn't a permission problem), but it doesn't help. The empty trash button is greyed out. I can, however, use the GNOME- panel trash-applet to empty the trash. Just tried to reboot, no change.
