@Theo So files that are being updated are immediately marked on-disk as zero-byte but then the actual replacement write is delayed? Doesn't that guarantee data-loss in the event of a crash? Or, have I massively misunderstood your explanation for how this is all the fault of those 'crappy' System programmers?
