I know the release is around the corner, but shouldn't the upgrade tool revert users to the opensource driver? We can warn them that they will need to add it later, but at least the upgrade will complete successfully. And hopefully the "hardware drivers" tool will not recommend to install fglrx until it's ready to support 9.04.
This is a serious bug for the upgrade, for most users it would mean a need to restart from a CD and wipe out the current, borked installation.
