OK, I finally got around to trying again with the 9.4 driver fglrx-8.602
on my amd64 Hardy ubuntustudio.
Automatic installer gave me these messages in /usr/share/ati/fglrx-

What I discovered was that the patch is not put in
/var/lib/dkms/fglrx/8.602/build/patches/ but in
/var/lib/dkms/fglrx/8.602/build/patches/patches. This fglrx.ko thing is also a
little troubling.
