Fresh install. As stated in the description. The fix is to open the option panel and change it to "open in a new window" then close options, then open options and change back to "open in new tab". After this firefox bahves as expected even after restarting it. If I remember correctly it exhibited the same behaviour in both windows and os x (10.4) too. But only on a fresh install of firefox.
