It may have been fixed in hardy but it is doing it in Jaunty (I have all the 
latest updates as of today)
going into the systems setting, file associations it is possible to edit the 
entries for kate from kate %U to kate -u %U.  This is rather time consuming and 
although it results in each file being opened in a single insidence of kate 
(like it has ever since I have been using Kubuntu, 3 or more years) it also 
results in a dialogue pop up saying could not run /usr/bin/kate
