I see this too, but only when I plug in power when the laptop is running. If I 
boot up with AC connected, the disk does not spin down. Probably the system 
just misses the transition from battery to AC here.
I assume it has something to do with laptop-mode missing the event. After I 
plug in power, laptop mode is on state "2" (whatever that means). After running 
the laptop_mode program, it jumps to "0", and the disk does no longer spin down:

$ cat /proc/sys/vm/laptop_mode 
2
$ sudo laptop_mode 
Laptop mode enabled, not active
$ cat /proc/sys/vm/laptop_mode 
0
