I think this was a design decision in order to allow space for the
overlays for filesystem types (for instance). Without including the
space for the overlay the icon would not sit in a row with other similar
icons and would appear to jump when the icon changes from one type to
another. This is an issue of changing all the icons based on the folder
not just the one icon.
