solved for me. The procedure and it's a bit strange but as no dev are interested that won't be solved at least not with my help dpkg has been upgraded for me.
So the trick to do it is really simple: use aptitude to do the upgrade. I you are using dpkg, apt-get, synaptic that won't work but with synaptic it's working.
