It's useful if you don't use indicator-session or if you use another another 
notification area (like in Awn). I am agree that it should be fixed in empathy, 
but this is quite more intrusive (changing libempthy-gtk/empathy-image.h, all 
hicolors_status* icons and the corresponding Makefile) than making temporally 
symlinks in the icon them. Also, this change in empathy will break others theme 
icons if they don't provide "fall back" to user-* icons. I'm still think that 
is not recommended to do this so close to the release.
And if the default is used, it's completely invisible because the empathy tray 
icon is hidden by default.
