The problem persists in Empathy 2.28.1. '~$ uname -a; Linux T43 2.6.31-14-generic #48-Ubuntu SMP Fri Oct 16 14:04:26 UTC 2009 i686 GNU/Linux'. I noticed that calling Empathy by clicking Applications > Internet > Empathy Instant Messenger will not produce any new window nor applet but starts a process. Only clicking this sequence a second time will produce the "Contact List" window.
