Having just spent 2 hours trying to get my apache working again (because of this issue) in 9.10 (and yes I tried but failed to find an existing bug until I tried to report it, having figured it out) - I question whether it is indeed invalid.
I agree that it should probably be a php5 bug rather than zend- framework, but a bug nonetheless - this is hardly obvious, and ubuntu does not implicitly enable a default include_path (nor does it seem to need it for operation of most php components in my experience).
