Did some more testing and found out some interesting facts: if you use a driver 8.26.18 or 8.27.10 correctly (fglrxinfo shows that you are using the driver), the problem is still there...
...if you replace the fglrx.ko module which comes with it, with the one from the restricted modules, a driver mismatch is beeing caused and the problem disappears! - of course there is no 3D support. Most interesting bit: if you unload the module (which is possible while X is running as there was a mismatch and it isn't beeing used), the problem is back and it disappears as soon as you reload it.
