You can find the patch and the Ambiance theme (Namely Ambiance-Test) modified to use backgrounds with transparency. Now, all works fine. There is just one little problem left : When you include spacer between two buttons, it didn't have background. With this patch, you can place buttons like you want. If there is only one button, no background drawn behind (So works clean with menu:minimize,maximize,close). And you can use backgrounds with some transparency.
