The issue ist, that upstart issues a "mountall" which IMHO triggers
fsck.

That can be cicumvented by the kernel parameter init= and some shell,
like bash or dash - but these fail too! That is really darn sad! neither
bash not dash work when invoked by the kernel, please tell me that there
is some shell left ... uh, statis-sh fails too, almost forgot.
