Just got this again a different way! 0) I had empathy's main buddy window open with no chat windows. 1) I clicked on its launcher icon to raise it. It was raised, but the launcher icon disappeared and the launcher contracted to take up the missing space (like it does when I close a window). But empathy was still open and staring me in the face! 2) I was like, "Huh, what happens if I click on it's panel applet?" (for some reason this empathy had opened with an old school GtkStatusIcon not a messaging indicator). I clicked on it (I don't remember if once or twice before I got the bug), and then the launcher opened up again to make room for an empathy icon, but did not insert an icon!
