I am having the same issue. After getting the 2.6.38 kernel, the
brightness keys stopped working.

The keys work if you add acpi_osi=Linux to your kernel boot options but
the brightness control still doesn't work properly. When you continually
press the increase button and it gets near the upper end of the
brightness scale, it just starts flipping back and forward between dim
and bright. At lower brightness levels the controls work as expected.

I tried updating the BIOS and adding acpi_backlight=vendor to the kernel
boot string but it didn't make any difference.

I have an Asus Eee PC 1015PEM.
