Natty with have some 2.6.38 eeepc related patchs. So you can try to
use a natty kernel, or a 2.6.38 + acpi4asus-dkms.
Could you try to do that, and check:

- the touchpad file
- cpufv with acpi debugging enabled (see previous message)
