I still see this issue with a freshly created user.
$ gconftool --get /apps/metacity/general/show_maximized_titlebars
true
This is on a "fresh new user" (created by 'adduser' minutes ago).
The issue is "fixed" by setting
gconftool --set --type bool /apps/metacity/general/show_maximized_titlebars
false
It would seem this should be the default if running under gnome-session
