Hm. This patch ( https://bugs.launchpad.net/debian/+source/toshset/+bug/644898/+attachment/1785664/+files/toshiba_acpi.patch _ seems to be stable with 2.6.38. BTW, you can compile just the needed module.
Here is the archive with the source, Makefile and precompiled module.
