Having tried many combinations all ending in the same file system
creation error and managed to destroy the GRUB in the process.  I used
Vista recovery to get back Windows, then used 10.04 live CD give me Disk
Utility. With that I removed all the Linux partitions, except the last
swap file that refused to be changed in any way. I then checked that
windows was still there. It was irritated and went into a long and
unsuccessful look for something to fix, but then rebooted happily. Then
I successfully installed 10.04 2 LTS.

So the bug is still there, I suspect something wrong on my hard disk
which prevents ext4 creation or removal of a swap file partition, which
is now containing it.
