Just by looking at this bug report, it smells like the race condition
that I fixed with upstream commit
3b06b3ebf44170c90c893c6c80916db6e922b9f2, which was released in
v3.0-rc1. The upstream bug is:

Unfortunately, there are two code cleanup patches that you'll first have
to apply to a 2.6.39 kernel. I was hoping to do a small bug fix patch
that I could get into -stable, but I didn't see an easy way to do it
without cleaning up the code quite a bit. You'll need to apply the
patches in this order:

3. 3b06b3ebf44170c90c893c6c80916db6e922b9f2
