I have also had the experience of the 2.6.38-10 upgrade breaking resume from RAM for me. It will usually always resume successfully the first time, but subsequent subsequent suspend/resume cycles without a reboot in between result in various symptoms: most often, power light, wifi light come on an stay on, hard drive and cd-drives spin up, but screen doesn't come on--not even the backlight (suggesting to me that it is related to the nvidia cards we both have), other times just the power light will come on and the screen will stay blank, once I got a traditional kernel panic--white flashing cursor.
I'm running a Dell Latitude D630 with an Nvidia NVS 135M graphics card, which I'm guessing is the source of the problem.
