I agree. I've got a feeling that the fix for this is upstream commit 3b06b3ebf44170c90c893c6c80916db6e922b9f2 but when I wrote that patch it depended on several other patches that aren't in the natty (or older) kernels. I started working on a backport, but it was getting too large.
