Chris, We generally prefer the author of the driver to submit it upstream. There would have to be a fairly widespread impact for the driver to be included in Ubuntu while not upstream.
Its interesting that the rt2800pci driver claims to support the device. It would be good to know if the card ever worked in previous releases with the rt2800pci driver. Would it be possible for you to test this? You could boot from a LiveCD[1] and test with re-installing your system.
