@Robert That's why i proposed a similar approach, but with a few tweaks (appear on mouse over instead of click and possibly an horizontal layout instead of vertical to match better the current behavior but for non maximized):

Anyway with the new gimp's "monowindow" coming soon: http://www.omgubuntu.co.uk/2011/08/gimp-2-7-3-released-working-single-window-mode-layer-groups/ would be rare that it wouldnt be used fullscreen, so the menu (fullscreen) would have the same behavior it has now.
