not sure if this is relevant. I tried to set the governor by hand using

root@laptop:~# cpufreq-selector -g ondemand

the CPU dipped down to half and cpufreq-info reported "ondemand" for
about a second before the CPU was set back to performance.

uname -r
2.6.31-23-generic
